Legal Agreements

These terms contain crucial information that impacts your rights, remedies, and obligations. Key points include, Arbitration Agreement: Disputes will be resolved through arbitration unless you opt-out. Introduction

CruiseSD (“CruiseSD”, “we”, or “us”), provides an online platform that connects locals, travelers, or workers who seek to rent a vehicle. CruiseSD is accessible online including at cruisesd.rentals and soon, as an application for mobile devices. By accessing or using our services (rent a car) including by communicating with us or other CruiseSD members, you agree to comply with, and be legally bound by, the provisions of these Terms of Service. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and CruiseSD.

Eligibility / Requirements / Verification

Age Requirement: Renters must be at least 21 years old. Renters can not rent a car for somebody else. The primary person who books the vehicle must be the one to pick up the rental and must have valid identification. Military personnel and government employees may rent at 18 years old (proof of active duty or government employment required).

Driver's License: A valid current driver's license is required for all drivers and must REMAIN valid through the entirety of the rental period. 

Insurance: Proof of insurance is required upon receiving the vehicle. Renters without their own coverage must purchase insurance through CruiseSD. Those accommodations should be made before the rental period to avoid complications.

Driving Record: A clean driving record is preferred. Recent traffic violations may result in denial of rental. We will not rent a vehicle to a suspended license. â€‹â€‹â€‹â€‹

Other RequirementsRenters must comply with all applicable laws and rental company policies during the rental period. The vehicle must not be used for illegal activities, off-road driving, or towing without prior authorization.

Booking / Cancellation 

Customers may book/rent any car weeks in advance or any available vehicle up to an hour and a half before it is needed and have it delivered or picked up at no additional cost. Guests may also cancel their booked vehicle up to 12 hours before the agreed rental start period which is arranged by the guest themself. If a last-minute cancellation is needed by the renter, any necessary accommodations must be requested directly by communicating with the designated and/or appointed customer service representative at the time of the booking. Cancellations are effective immediately. Whether the guest received a full refund, a partial refund, or receives no refund depends on the circumstances. The total amount refunded will depend on when the guest cancels the trip, the length of the trip, and the trip type. 

Returns / Guest commitments

As a guest, you commit that you will be a legally licensed driver and provide proof to the rental agent of a current, valid driver’s license. You will treat the vehicle and any installed extras well and will take ALL reasonable measures to return the vehicle and any applicable extras on time and in essentially the same condition as received to an agreed-upon location specified in your reservation and or accommodated for. You will not allow anyone other than a person listed in the trip details to drive the vehicle you booked. 

Payment methods

A valid credit card in the renter's name is required when booking the rental and may be requested for verification upon arrival/pick up of the vehicle. Debit cards may be accepted with possible additional requirements such as a credit check or proof of return travel plans. Debit card name MUST match driver's license. Prepaid cards are not accepted. Cash may be accepted depending on the rental scenario and only if properly documented with a live rental service agent. All payments can be made online through our website swiftly and securely. 

Vehicle Theft / Damage 

Engaging in any of the following actions may result in the vehicle you booked being reported as stolen to law enforcement. This could lead to arrest, civil and/or criminal penalties, and the cancellation of your protection plan:

  • Failure to return the vehicle at the agreed-upon time and location specified in your reservation or as arranged with the host.

  • Not returning the vehicle by the end of the reservation period without properly extending the reservation with an agent

  • Returning the vehicle to a location other than the one specified in your reservation or agreed upon with the host. Any damage, loss, or theft occurring before the agent inspects the vehicle upon return is the guest’s responsibility.

  • Providing false information to the agent regarding the booking, use, or operation of the vehicle.

  • Leaving the vehicle unlocked, running, or unattended with unsecured keys, resulting in theft or damage to the vehicle or its interior components.

  • Failing or refusing to communicate in good faith with the agent, police, CruiseSD, or other authorities about any accident or vandalism involving the vehicle, or failing to cooperate in related investigations.

  • Operating the vehicle under a false name, address, or invalid driver’s license, or if the driver’s license becomes invalid during the reservation period. Additionally, obtaining the keys without the host’s permission or misrepresenting or withholding facts from the host or CruiseSD about the booking, use, or operation of the vehicle.

 

The primary guest who makes the reservation is responsible for any private investigation costs deemed necessary by CruiseSD to recover a vehicle that is not returned. CruiseSD or an authorized agent may repossess the vehicle without notice, at the guest’s expense, if the vehicle is not returned by the end of the reservation, is found illegally parked, abandoned, or used in violation of the law or these Terms.

Missing Vehicles: If the vehicle you booked through the CruiseSD goes missing or is stolen during the reservation period (or extension), you must immediately return the original ignition key to the host and file a police report within 12 hours of discovering the vehicle is missing. You must fully cooperate with the host, law enforcement, CruiseSD, and other authorities in all matters related to the investigation.

The guest who booked the trip (“primary guest”) is financially liable for all physical damage to or theft of the booked vehicle that occurs during the trip, along with any additional costs and fees resulting from any kind of damage to the vehicle, regardless of fault. This liability applies whether or not the primary guest has their own auto insurance.

Primary guests may have coverage for damage to the booked vehicle under their own automobile insurance policies. By booking a vehicle on CruiseSD, you agree that if any damage occurs to the booked vehicle during your trip, you will work with CruiseSD to file a claim under any applicable insurance policy.

Incident reporting / responsibility 

You must immediately report any damage to the vehicle you are using to cruisesdrentals.gmail.com, or (619) 707- 6219. If there has been a collision you must also make a report to the police (CHP) If an accident results in injury, death, or property damage over $1,000, it must be reported. You must make every reasonable effort to gather evidence from any available witnesses and provide CruiseSD or third-party claims administrators with a written account of the incident, along with any other requested information, including the identity and insurance details of all parties involved. You are also obligated to cooperate in any loss investigation conducted by CruiseSD, third-party claims administrators, or insurers. After an incident involving more than minor vehicle damage (e.g., small dent or scratch), you may not continue using the vehicle without explicit permission from CruiseSD staff. Failure to promptly report an incident or cooperate in an investigation may diminish or void any protection plan obtained through/with us.
